A Matter of Interest: Traumatic Brain Injury

One interesting litigation matter Vincent handled involved determining whether the plaintiff sustained a traumatic brain injury (TBI) or was falsely claiming a TBI. Because the existence of a TBI cannot always be measured objectively, Vincent’s challenge was to disprove the existence of the plaintiff’s TBI. Vincent conducted detailed and extensive discovery, which showed the plaintiff had pre-existing symptoms which mimicked a TBI and that the plaintiff had not been candid regarding the manner in which the alleged incident occurred. By conducting a thorough and pointed cross-examination of the plaintiff, Vincent was able to disprove the TBI and successfully resolve the matter for his client.
