BIOGRAPHY

Attorney Shelton’s practice focuses on Financial Institution Services, Real Estate Closings, Consumer Litigation and Debt Collection. She has represented banks and lenders in loan closing transactions, as well as litigated related issues concerning consumer lending and servicing violations, real property title and boundary disputes, property conveyance, zoning, permitting, easements, foreclosure, tax sales, eviction, garnishment, and debt collection. Attorney Shelton also provides document drafting, review and negotiation services for corporate entity formation and dissolution, title documents, contracts, commercial contracts and leases. She also develops strategies for clients to manage and mitigate risks—helping clients comply with state/federal law while meeting their business objectives.

Attorney Shelton has practiced for 13 years, earning her Doctorate of Juris Prudence at The University of Texas School of Law as a Texas Leader Scholar, and B.A.’s in Business and Political Science at Southwestern University as a Presidential Scholar. She is admitted to practice in Georgia, Tennessee, U.S. District Court for the Northern & Middle Districts of Georgia, and the U.S. Court of Appeals. She was nominated to serve as a 2014 Fellow for the Leadership Council on Legal Diversity (LCLD), and served as an LCLD Advocacy Group Leader. She has participated in the National Association of Women & Minority Owned Law Firms (NAMWOLF), the Commercial Law League of America (CLLA), and the GA State Bar’s Real Property Law Section and Minorities in the Profession Committee, and the State Bar’s Annual High School Mock Trial program.

Ms. Shelton is an experienced litigator in the realm of mortgage loans, consumer loans, mobile home loans and commercial transactions. This extends to defending clients for violations of RESPA, TILA, HUD/VA regulations, HAMP, CFPB, FDCPA, UCC, data privacy, credit reporting, broker prohibited acts, and other federal & state consumer protection law violations. She has overseen residential and commercial foreclosures in Georgia, Tennessee and Florida; also serving as substantive counsel in other jurisdictions, including Arizona, Arkansas, Colorado, Indiana, Iowa, Massachusetts, New Mexico, Nevada, New York, North Carolina, and Wisconsin. She handles debt acceleration & collection, confirmations of foreclosure sale, confirmation of arbitration awards, suits on promissory notes, recovering commercial collateral, personal property/automobile replevin, surety bond claims, broker commission suits, evictions, garnishments, domesticating judgments, bankruptcy stay relief, proofs of claim and title-related adversary actions. She facilitates loan workouts, modifications and settlements on behalf of creditors. Ms. Shelton previously served as relationship partner to Fannie Mae to manage attorney performance and compliance timeframes required to maintain attorney designation.

REAL ESTATE LITIGATION

Ms. Shelton utilizes the litigation process to enforce clients’ interests in real property and personal property. She also provides pre-litigation case assessment, settlement strategies and case recommendations. Ms. Shelton has particular expertise in title litigation, helping clients preserve their secured interest against other creditors, bonafide purchasers, tax sale deed purchasers, lien-stripping and other title challenges. She has handled actions for reformation of title, adverse possession, declaratory judgments, establishment of lost records, subrogation, injunctions and other equitable relief. She facilitates the surrender and disposition of collateral, personal property & real property, distressed real estate and commercial receiverships.

REAL ESTATE TRANSACTIONS

Ms. Shelton conducts closings for residential and small commercial property loans, real estate purchases, leases, large asset portfolios, and commercial loans secured by personal or intellectual property.  She also negotiates and structures lease-purchase deals and commercial landlord-tenant transactions; representing clients on various sides of the transaction. Ms. Shelton resolves issues related to zoning & financing, surveys, disputes, marketable title and title certification. She reviews, drafts and negotiates documents (i.e. construction and subcontractor agreements, vendor service agreements, purchase & sale contracts, power of attorney, assumptions, subordination agreements, commercial guaranties, asset assignments, assignment of rents, materialman’s liens, deeds, title affidavits, loan modifications, forbearance agreements, deeds-in-lieu of foreclosure, workouts, homeowner’s association covenant revisions, and mobile/manufactured home title retirement).
